1. Parties and Scope

These Terms of Use govern the use of the website www.truemed.com.tr (the “Website”) operated by Truemed Medikal Ürünler Üretim ve Pazarlama A.Ş. (the “Company”), established at Şerifali Mah. Türker Cad. No: 15 İç Kapı No: 1, Ümraniye, İstanbul, Türkiye.

Anyone who visits or uses the Website (the “User”) declares that they have read and agree to comply with these Terms of Use. If you do not accept these Terms of Use, please do not use the Website.

2. Nature of the Website Content

The Website has been prepared to provide general information on the Company’s orthopaedic trauma implants, surgical instruments and activities, and its content is primarily intended for healthcare professionals, healthcare institutions, distributors and industry professionals. Accordingly:

The information on the Website does not constitute medical advice and does not replace a physician’s assessment regarding diagnosis, treatment or the choice of surgical technique.
The Company’s products must be used only by physicians with the necessary training and competence, in accordance with the instructions for use (IFU) and labelling of the relevant product. The documents to be relied upon in the use of the products are the current instructions for use and technical documents supplied with the product.
Product images on the Website are for illustrative purposes, and the technical specifications, dimensions and range of the products may be changed without prior notice.
Not all products shown on the Website may be available for sale in every country; the registration, authorisation and market availability of the products may vary from country to country.
No information on the Website constitutes an offer for sale or a binding commitment. Price quotation, distributorship and other requests submitted through the contact form do not oblige the Company to enter into any contract; sales and cooperation relationships are established only through separate written agreements between the parties.

Although the Company exercises reasonable care to keep the Website content accurate and up to date, it does not guarantee that the content is complete, error-free or always current.

3. Intellectual Property Rights

All intellectual and industrial property rights in the content of the Website, including the TRUEMED trademarks and logos, product designs, catalogues, technical drawings, photographs, videos, texts, graphics, software and the design of the Website, belong to the Company or its licensors and are protected under applicable legislation, in particular the Industrial Property Law No. 6769 and the Law No. 5846 on Intellectual and Artistic Works.

Catalogues and documents on the Website may be viewed, downloaded and used internally solely for the purpose of obtaining information about the Company’s products. The Website content may not, in whole or in part, be reproduced, modified, adapted, distributed, published, used for commercial purposes or used for the purpose of imitating product designs without the Company’s prior written consent. Use of the Website does not grant the User any right or licence in the Website content.

4. User Obligations

The User agrees to use the Website in compliance with the law and these Terms of Use. In this respect, the User shall not:

engage in any activity that disrupts, impedes or places an excessive load on the operation of the Website or the systems on which it is hosted;
attempt to gain unauthorised access to the Website or its connected systems, or upload viruses or malicious software;
collect or copy the Website content by automated tools (bots, spiders, scrapers, etc.);
send untrue, misleading, unlawful or offensive information or unsolicited commercial messages (spam) through the contact form;
share personal data of third parties without authorisation or submit requests on behalf of others without authority.

The User should not include special categories of personal data, in particular health data of patients, in the contact form.

5. Third-Party Links

The Website may contain links to websites of third parties, such as social media accounts and map services. These links are provided for convenience only, and the Company is not responsible for the content, security or privacy practices of such websites.

6. Limitation of Liability

The Website is provided “as is” and “as available”. The Company does not guarantee that the Website will be uninterrupted, error-free or free of viruses or other harmful components. Subject to cases of wilful misconduct or gross negligence of the Company and to mandatory rules of law, the Company shall not be liable for any direct or indirect damages arising from delays or interruptions in access to the Website or from the use of or inability to use the Website content.

The Company shall not be liable for the Website being inaccessible due to force majeure events beyond its control and not reasonably foreseeable, such as natural disasters, epidemics, war, cyber-attacks or infrastructure or power outages.

Information on personal data processed through the Website is set out in the Website Privacy Notice and the Privacy Policy, and information on cookies is set out in the Cookie Policy.

The Company reserves the right to change the content of the Website and these Terms of Use at any time and to suspend or discontinue the Website temporarily or permanently. The current version of the Terms of Use enters into force on the date it is published on the Website.

9. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

10. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Republic of Türkiye. For disputes arising from these Terms of Use or the use of the Website, the Courts and Enforcement Offices of İstanbul Anadolu shall have jurisdiction with respect to Users who are merchants or public legal entities, in accordance with Article 17 of the Code of Civil Procedure No. 6100.
